MAIA chatbot or MAIA Virtual Assistant is provided to you by or on behalf of the Government of Mauritius (together with our representative, the Ministry of Information Technology, Communication and Innovation; collectively, ("we", "us"" or "our").
By accessing, using, downloading, installing and/or accessing any part of MAIA platform, MAIA mobile app, MAIA website, MAIA SMS channel and/or the MAIA Material, as the case may be, you acknowledge that you have read and understood these Terms and unconditionally agree and accept to be legally bound by and to comply with these Terms and any amendments thereto from time to time. Any non-compliance with these Terms, whether intentionally or otherwise, may result in action being taken against you, including but not limited to a claim for compensation and civil and/or criminal liability.
The accessibility and operation of MAIA services may rely on technologies outside our control. We do not guarantee continuous accessibility or uninterrupted operation of MAIA services.
If you are using MAIA services or any part thereof on behalf of an Organisation, you hereby represent and warrant that you have been validly authorised to: access or use MAIA platform on behalf of your Organisation; and agree to and bind your Organisation to these Terms.
In such circumstances, any reference to "you" in these Terms will include your Organisation.
Kindly ensure that you access or use MAIA services from legitimate sources only (i.e. MAIA mobile app, the MAIA Website and/or the Approved Online Stores) and check that the MAIA and the MAIA Materials are indeed operated and/or published by the Government of Mauritius (or its appointed representative, the MITCI) before you access or use MAIA or download the MAIA Materials, as the case may be. We shall not be responsible or liable to you for any losses, costs, expenses or damage suffered or incurred by you or any third party arising from any imitation, spoof, phishing or similarly fraudulent or unauthorised digital services downloaded or accessed by you from illegitimate sources or which are not published or operated by us.
We reserve the right to change, modify, or remove the contents of the MAIA Site, MAIA mobile app or content of other MAIA channels at any time or for any reason at our sole discretion without notice. However, we have no obligation to update any MAIA content. We also reserve the right to modify or discontinue all or part of the MAIA service without notice at any time. We will not be liable to you or any third party for any modification, suspension, or discontinuance of the MAIA services.
We cannot guarantee the services will be available at all times. We may experience hardware, software, or other problems or need to perform maintenance related to the MAIA platform, resulting in interruptions, delays, or errors. We reserve the right to change, revise, update, suspend, discontinue, or otherwise modify the Site at any time or for any reason without notice to you. You agree that we have no liability whatsoever for any loss, damage, or inconvenience caused by your inability to access or use the services during any downtime or discontinuance of the services. Nothing in these Terms of Use will be construed to obligate us to maintain and support the Site or to supply any corrections, updates, or releases in connection therewith.
These Terms shall be governed by and defined following the laws of Mauritius. Ministry of Information Technology & Communications and yourself irrevocably consent that the courts of Mauritius shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.
These Terms of Use and any policies or operating rules posted by us on the Site or in respect to the Site constitute the entire agreement and understanding between you and us. Our failure to exercise or enforce any right or provision of these Terms of Use shall not operate as a waiver of such right or provision. These Terms of Use operate to the fullest extent permissible by law. We may assign any or all of our rights and obligations to others at any time. We shall not be responsible or liable for any loss, damage, delay, or failure to act caused by any cause beyond our reasonable control. If any provision or part of a provision of these Terms of Use is determined to be unlawful, void, or unenforceable, that provision or part of the provision is deemed severable from these Terms of Use and does not affect the validity and enforceability of any remaining provisions. There is no joint venture, partnership, employment or agency relationship created between you and us as a result of these Terms
of Use or use of the Site. You agree that these Terms of Use will not be construed against us by virtue of having drafted them. You hereby waive any and all defenses you may have based on the electronic form of these Terms of Use and the lack of signing by the parties hereto to execute these Terms of Use.
2.1 The Government of Mauritius and/or its employees do not accept any liability, however arising, including liability for negligence, for any loss resulting from the use of the app or reliance upon the information provided and/or reliance on its availability of services provided through the use of the app.
3.1 Misuse and abuse of the MAIA services, such as impersonation and inappropriate content, will be reported to relevant authorities. Users must not (and must not permit anyone else) to contravene any laws of the Republic of Mauritius and use the MAIA services solely for its intended purpose.
4.1 Personal data provided by users upon registration for the app shall be processed in accordance with the Data Protection Act 2017.
4.2 Personal data of users of MAIA services will be used in order to:
4.2.1. help identify the user when using the MAIA services;
4.2.2. personalise the MAIA services to better assist the users;
4.2.3. collect statistical data; and
4.2.4. improve the service to users of the MAIA platform.
4.3 the data controller is the Ministry of Information Technology, Communication and Innovation
4.4 the intended recipients of the data will be Ministry of Information Technology, Communication and Innovation;
4.5 the supply of the data by the user is mandatory for the use of the MAIA services;
4.6 the user may at any time withdraw consent to the processing of personal data, without such withdrawal affecting the lawfulness of the processing based on consent before such withdrawal;
4.7 the user has the right to request from the data controller the right to access to and rectify or erase the personal data concerning him or to object to such processing;
4.8 should the app be used for automated decision making, personal data of users will be processed in accordance with the provisions of the Data Protection Act 2017;
4.9 transactional data shall be stored in the backend for a maximum of five years and personal data of users may be removed from our backend system upon request;
4.10 users have the right to lodge a complaint with the Data Protection Commissioner in the event the provisions of the Data Protection Act 2017 is being breached in respect to them.
By using the MAIA services, you agree to the processing of your personal data provided by you in accordance with the present terms and conditions.
